INFORMATION ON THE PROPOSED LOS ANGELES CITY MEDICAL MARIJUANA ORDINANCE HOW YOU CAN PARTICIPATE IN THIS HISTORIC LEGISLATION Perhaps the most striking thing about the proposed ordinance, is that the City of Los Angeles wants medical marijuana patients to surrender basic constitutional rights, trading them for safe access to life sustaining medicine. Below are some of the more draconian rules the ordinance would impose on patients: (1.) State law mandates that MM be made available to patients, not zoned out of existence. Any sensitive use restrictions, whether they are 500 feet, 1000 feet and include or don't include residential, are legally impermissible if they so restrict MMD's that state law is frustrated. Likewise, letting individual council members opposed to medical marijuana dispensaries set footage distances in individual districts is a bad idea. They can simply zone dispensaries out of existence. [Section 45.19.6.3 subsection (A) (2) page 8] [Jan Perry motion available at: http://clkrep.lacity.org/onlinedocs/..._12-16-09.pdf] (2.) The current ordinance would allow patients to register with only one dispensary. This is a violation of the basic constitutional right to freely assemble for any legal purpose. [Section 45.19.6.3 subsection (B) (15) page 11] (3.) Police can come into a medical marijuana dispensary at any time, and without a warrant or subpoena, obtain your name, address, phone number and any other information about you not deemed a medical record. They don't consider your doctor's recommendation to be a medical record. [Section 45.19.6.4 page 11] You can read the proposed ordinance at: http://clkrep.lacity.org/onlinedocs/...ty_12-9-09.pdf A last minute motion by Jan Perry, which would allow council members to decide sensitive use issues independently within their own districts can be seen at: http://clkrep.lacity.org/onlinedocs/2008/08-0923_mot_12-16-09.pdf On Wednesday, January 13, 2010, at 10 A.M., the Los Angeles City Council will debate its medical marijuana ordinance for the last time, and will most likely vote on it at that point. The public entrance to City Hall is located at 250 Main Street. (The Spring street entrance is no longer open to the public.) The meeting will be held in the John Ferraro Council Chamber, 3rd floor, Room 340. Parking is available in the Los Angeles Mall across the street. The City of Los Angeles will be the largest municipality in the country to have voted in a medical marijuana ordinance, come witness this historical event. Activists are asking that patients contact Los Angeles City Council Members with their concerns before the meeting. Below is all the information you need to contact the Los Angeles City Council. Even calling after hours is helpful, they log the calls. If you find the ordinance to be an impermissible restriction of your constitutional rights, please let City Hall know.
